Terms and Conditions

1. Seller. This website and all services are operated by Giardina Atelier LLC, a Texas limited liability company.
2. Custom work. All services are custom and made to order to the client's own design and specifications.
3. Payment. Payment is due in full at checkout, or according to a payment schedule agreed in writing with Giardina Atelier. If a scheduled payment is late, work and delivery pause until it is received.
4. Refunds and cancellations. Work begins once your order is placed and we have received your final design details through our order form, which we send you after checkout. Turnaround times are counted from that point. You have 24 hours after submitting the form to request any changes. After that, no further changes can be made and work proceeds as submitted. All sales are final. No refunds, returns or cancellations are accepted. Because every order is custom made to the client's specifications, statutory rights to cancel or withdraw from distance purchases do not apply, to the extent permitted by law.
5. Timelines. Each project is custom and follows an iterative creative and technical process. All timelines and turnaround times are indicative and not guaranteed. Design complexity, pattern-making questions and atelier scheduling can affect them; if your timeline changes, we'll be in touch. Timelines pause while we wait for the client's answers, approvals or payments. A change in timeline does not entitle the client to a refund or cancellation.
6. Deliverables, design details and changes. Each order includes only the deliverables described on the product page at the time of purchase. Design changes requested after work begins, and any work outside that description, are new work and are quoted separately. After payment, the client submits their design details through our order form, and we begin the project based on those details. Changes to the design itself can be requested within 24 hours of submitting your final design details through our order form. After that, no further design changes can be made, and any change to the design, whether during development or after delivery, is treated as a new order.
7. Communication and approvals. All questions, approvals and change requests are made in writing by email. If the client does not respond to a question or approval request within 30 days, the project may be paused or closed without refund.
8. Delivery. Couture Tech Packs are delivered by email as a PDF, together with the original editable Adobe Illustrator file. Couture Patterns are hand-drafted on paper and shipped by express courier, with tracking, to the shipping address provided at checkout. Shipping is included. Please make sure your address is correct, as we cannot be responsible for delays caused by an incorrect address or by customs. Any import duties or taxes are the client's responsibility.
9. Review and edits. On delivery, you have 72 hours to review your tech pack and request one complimentary round of edits. If we don't hear from you within 72 hours, your order is considered complete and accepted. Couture Patterns are final as delivered. Edits cover corrections to the delivered tech pack only, so that it accurately reflects your submitted design.
10. Scope of the Technical Foundation. The Technical Foundation is complete on delivery of your tech pack and pattern. Any refinements made during sampling, fittings or production, including updates to the pattern and tech pack, form part of sample development and are carried out by your sample maker. Where Giardina Atelier develops your sample, these updates are included in that work. Where sampling takes place with another partner, they are the responsibility of that partner.
11. Client information and materials. The client is responsible for the accuracy of the designs, measurements, references, fabrics and information they provide.
12. Use of deliverables. The fit and finish of any garment depend on fabric, cutting and sewing. Giardina Atelier is not responsible for samples or production made by third parties using our deliverables.
13. Ownership. Once the order is paid in full, the client owns all patterns, tech packs, files and other work Giardina Atelier creates for that order. Giardina Atelier claims no ownership of the client's designs or deliverables. If a payment is reversed or charged back, ownership does not transfer and the client may not use the deliverables.
14. Confidentiality. We keep client designs confidential and share them only with our own technical team, under confidentiality, to complete the order.
15. Limitation of liability. Our total liability for any order is limited to the amount paid for that order. We are not liable for indirect losses such as lost profits, missed launches or production costs.
16. Questions and disputes. Any concern about an order must first be raised with us at studio@giardinaatelier.com. We respond within 3–5 business days. The client agrees to contact us before disputing a charge with their card issuer. If a chargeback is filed, we will provide these Terms, the checkout record and proof of delivery to the card issuer.
17. Changes to these Terms. We may update these Terms. The version in force when the order was placed applies to that order.
18. Governing law. These Terms are governed by the laws of the State of Texas, USA.
19. Acceptance. By placing an order and ticking the acknowledgement boxes at checkout, the client agrees to these Terms and the Refund Policy.
